When you think of Arizona, the Grand Canyon, beautiful sunsets, and giant cactuses might be the first things that come to mind. However, Arizona is also home to dozens of hemp farmers.
Arizona’s hemp program began issuing licenses to qualified applicants on May 31, 2019, allowing farmers to join the rush to grow America’s new crop. Despite the Grand Canyon state’s cautious warning that more research needs to be done to further the development of hemp as an Arizona crop, farmers from all over began applying for licenses. According to Arizona’s agricultural website, there are over 140 licensed growers in the state as of August 2020.
Arizona’s plan to implement the United States Department of Agriculture is currently under review. Once the USDA reviews it, it will either be returned to the state for edits/amendments or approved. The USDA’s website is regularly updated with information for all states and tribes.
However, the Arizona Department of Agriculture’s reach does not extend beyond licensing and cultivation. Their FAQ section on their website states, “… the Department’s oversight only extends from the growth and cultivation of industrial hemp, up to the point of processing. For licensed processors, the Program will focus on ensuring they receive raw material that is below 0.3% THC. If there are food handling laws, laws and regulations under the oversight of the Food and Drug Administration, or other laws related to manufacturing of another agency, then those issues are out of the Department’s scope of regulatory oversight.”
While the FDA’s website offers guidance on finished products such as tinctures and topicals, there is no current guidance on smokable hemp flower beyond labeling and claims that can be made concerning CBD in general.
For consumers, this means the smokable hemp market is very lightly regulated. At the time of this writing, consumers can purchase smokable CBD flower legally.
However, with the current climate, many consumers and retailers are opting to buy smokable hemp flower from the safety (and cleanliness) of their own homes. Consumers can read reviews from other people who have purchased the flower rather than just relying on what the salesperson has to say. But with thousands of options, choosing the right hemp company can be like finding the needle in a haystack.
Califloral has focused on providing all the good vibes and the feeling of summertime while remaining compliant with all state and federal laws. We ship our premium hemp pre-rolls nationwide wherever smokable hemp flower is legal.
Will my package be seized in the mail? The United States Postal Service considered this and established the following guidelines to avoid confusion.
- The mailer complies with all federal, state, and local laws concerning hemp and hemp-derived products.
- The mailer retains records detailing their compliance with all laws (COAs, licenses, or other similar documentation) for no less than two years after the mailing date.
